Introduction
Emnet omfatter regler som skal sikre at offentlig virksomhet drives og offentlige midler forvaltes på en mest mulig effektiv måte. Hovedvekten i emnet er lagt på reglene om offentlige anskaffelser, dette er regler som har som formål å sikre mest mulig effektiv ressursbruk ved inngåelse av offentlige kontrakter. En annen måte å effektivisere offentlig virksomhet på er å skille den ut i egne selskaper. Rettslige kjennetegn ved slike organisasjonsformer og konsekvenser av slik organisering behandles også. I tillegg omfatter emnet regler som legger særlige begrensninger på det offentlige som aktør på markedet (regelverket om offentlig støtte).

Knowledge
The student has
- the ability to take a critical approach to different forms of organisation and market contracting in the public sector
- insight into what the prohibition against public funding entails, with particular weight on what is meant by economic activity in the sense of the EEA Regulations, insight into the objectives that the rules on public procurement are intended to achieve, and the basic requirements that apply to public clients when engaging in procurement processes
- in-depth knowledge of the effect of the procurement regulations and of the rules on selecting the competition form, the execution and conclusion of the competitive process, including knowledge on the potential consequences of errors
Skills
The student is capable of
- identifying and analysing legal issues and consequences relating to restructuring or market contracting processes
- identifying when different parts of the regulations on public procurement apply
- analysing and handling legal issues when advertising tenders, and how to conduct this process, assess the tenders received and award contracts

Content
The topic of the course is the regulatory framework intended to ensure that public enterprises and public funds are managed in the most efficient way possible. It primarily deals with the rules on public procurement, which are rules aimed at ensuring the best possible use of resources when entering into public contracts. Another way of rationalising public enterprises is to define them as separate entities. The legal characteristics of such forms of organisation and its consequences will also be covered. The course also deals with the rules that place special limitations on the public sector as a market participant (The EEA Agreement's government assistance rules).
Teaching and learning methods
The teaching methods used are individual study, group work and plenary sessions. An important element of achieving the learning outcomes for this course will be the use of various case studies. Students are expected to be active in the work on these cases and work with the sources of law available in this field. Literature studies will be an important aspect of this work.

Assessment
The students will take an individual home exam over 48 hours. A case study will be an important part of the assignment.

Grading scale
A grade scale with grades from A to E for pass and F for fail is used.
Examiners
All answer papers are assessed by an internal examiner. External examiners are used in cases of doubt about whether a pass grade should be awarded and for spot check assessments of approx. 25% of the answer papers. The grades awarded for the answer papers assessed together with an external sensor form the basis for determining the level for awarding the different grades. The internal examiner shall take the external examiner's assessment into consideration in the grading of all the exams.
Admission requirements
Enkeltemner har samme opptakskrav som masterprogrammet:
- Bachelorgrad med minst 45 studiepoeng i organisasjons- og administrasjonsfag og to års relevant yrkespraksis eller:
- Bachelorgrad med minst 4 års relevant yrkeserfaring, hvorav minst 1 år i ledende stilling på mellomnivå eller høyere. Yrkespraksis skal være etter fullført bachelorgrad.
- Gjennomsnittskarakter på minst C fra bachelorgraden (eventuelt annet opptaksgrunnlag).
